FAQ:
Does the government have a right to cease assets in the us?

Yes, the U.S. government has the right to seize assets through legal processes like civil and criminal forfeiture, often because the assets are believed to be connected to criminal activity or are needed to settle a debt like unpaid taxes. This process can happen even without a conviction in civil cases, which can be a point of controversy.
Common reasons for asset seizure
Criminal activity: The government can seize assets if they are proceeds from a crime or were used to commit one, such as drug trafficking, money laundering, or fraud.
Tax debt: The IRS can seize assets, including bank accounts and stocks, to satisfy unpaid taxes, but usually after other collection attempts have failed.
Civil forfeiture: In civil cases, the government can seize property that is alleged to be involved in a crime, even if the owner is not charged or convicted. The legal action is taken against the property itself, not the person.
Criminal forfeiture: This is initiated as part of a criminal prosecution after a conviction. The government can seek forfeiture of assets that are the proceeds of or were used in the commission of the crime.
The seizure process
Seizure: The government physically takes possession of the property.
Forfeiture: A legal case is initiated to determine if the government has the right to permanently keep the seized property. This can be a civil, criminal, or administrative process, depending on the case.
Contesting the seizure: An owner typically has the right to contest the seizure through legal proceedings.
Key takeaway
While the government can seize assets for specific reasons, such as a criminal conviction or unpaid taxes, it can also use civil forfeiture to take assets based on the belief they are linked to illegal activity, sometimes without a criminal charge or conviction against the owner.

Civil forfeiture in the United States - Wikipedia https://share.google/HisaPNP818X6DaUjf

In the United States, civil forfeiture (also called civil asset forfeiture or civil judicial forfeiture)[1] is a process in which law enforcement officers take assets from people who are suspected of involvement with crime or illegal activity without necessarily charging the owners with wrongdoing. While civil procedure, as opposed to criminal procedure, generally involves a dispute between two private citizens, civil forfeiture involves a dispute between law enforcement and property such as a pile of cash or a house or a boat, such that the thing is suspected of being involved in a crime. To get back the seized property, owners must prove it was not involved in criminal activity. Sometimes it can mean a threat to seize property as well as the act of seizure itself.[2] Civil forfeiture is not considered to be an example of a criminal justice financial obligation.

The U.S. Marshals and GSA sold 2,000 dresses and accessories near Baltimore in 2015. The dresses were seized in connection with the criminal conviction of a woman who supported her wedding boutique by embezzling over $5 million from her employer.
Proponents see civil forfeiture as a powerful tool to thwart criminal organizations involved in the illegal drug trade, since it allows authorities to seize cash and other assets from suspected narcotics traffickers. They also argue that it is an efficient method since it allows law enforcement agencies to use these seized proceeds to further battle illegal activity, that is, directly converting value obtained for law enforcement purposes by harming suspected criminals economically while helping law enforcement financially.

Critics argue that innocent owners can become entangled in the process to the extent that their 4th Amendment and 5th Amendment rights are violated, in situations where they are presumed guilty instead of being presumed innocent. ****(People are presumed guilty until proven innocent except in a court of law) It has been ruled unconstitutional by a judge in South Carolina.[3][4] Further, critics argue that the incentives lead to corruption and law enforcement misbehavior. There is consensus that abuses have happened but disagreement about their extent as well as whether the overall benefits to society are worth the cost of the instances of abuse. [citation needed]

Civil forfeitures are subject to the "excessive fines" clause of the U.S. Constitution's 8th amendment, both at a federal level and, as determined by the 2019 Supreme Court case, Timbs v. Indiana, at the state and local level.[5] A 2020 study found that the median cash forfeiture in 21 states which track such data was $1,300.[6]

Victims Program
Returning assets to victims of crime is a top priority of the Department of Justice Asset Forfeiture Program. Since 2000, the victim compensation program has returned more than $12 billion in civilly and criminally forfeited assets to victims through the granting of petitions for remission or by transferring forfeited funds to courts for payment of restitution through the restoration process.

Use of Forfeited Funds
All across the country, federal, state, local, and tribal forfeited funds and property are being used to help protect and serve our communities and support law enforcement. For example, in Kentucky, forfeited funds were used to refurbish a facility to shelter child abuse victims in the state. And in New York City, forfeited funds are being used to advance community-based policing to better serve neighborhoods. These funds have financed an array of additional services and equipment, including:

A drug and alcohol treatment facility
Transportation to drug treatment services
Naloxone rescue kits for opioid overdose victims
A job skills program
A youth program aimed at drug and crime prevention
Afterschool programming
A plaque for a law enforcement officer killed in the line of duty
School resource officer salaries
Bomb-sniffing canines
911 call center equipment
Care for abused and rescued animals seized for forfeiture
Gun buy-back programs
Personal protective equipment for first responders
Community and crime-fighting organizations
Youth sports and summer camps, including equipment
Community gardens and public service projects
Upgraded technology and devices for local police departments, including bulletproof vests; body cameras; GPS devices in county patrol cars; two fast-response boats; hazardous-materials suits and tactical gas masks; incident command vehicle; DNA analyzer system; and bomb robot
Forensic training programs for law enforcement
Housing initiative funding
Grant funding for sexual assault kit testing
Garbage and pesticide removal from public lands
Forfeited funds also are being used to train law enforcement to ensure strict compliance with the Fourth Amendment, Due Process and Excessive Fines Clause of the U.S. Constitution when seizing and forfeiting property.

Examples of Forfeiture in Action
In July of 2024, a historic silver pocket watch that traveled the world with Theodore Roosevelt during his presidency, was returned to his family home at Sagamore Hill National Historic Site. The watch was missing for 37 years after it was stolen while on loan from the National Park Service (NPS) to a museum in Buffalo, New York, in 1987. NPS worked to recover the watch with the help of FBI's Art Crime Team. NPS then coordinated with the FBI to navigate the administrative forfeiture process, which was the process used to return the watch to Sagamore Hill.

In October of 2023, the United States, through the Department of Justice, completed the sale of a motel in Long Island for $2 million. Pursuant to the terms of the sale, any proceeds remaining after the property’s lenders have been compensated will be earmarked for forfeiture to the Government. This will enable the Department to seek their use in compensating victims at the center of a sex trafficking and narcotics conspiracy. For years, the motel was used to operate a sex trafficking business wherein several women, including a minor, were routinely subject to both mental and physical abuses. The criminals behind the conspiracy kept the females addicted to drugs and coerced them to engage in commercial sex acts in exchange for drugs. The forfeiture of these proceeds is part of the FBI’s ongoing effort to dismantle crime and compensate victims. Press release
